ZEPHYR AND STONE — Image Licence & Credit Agreement

These terms apply between Zephyr and Stone Pty Ltd (ACN 652 705 881) as trustee for the Zephyr Trust (ABN 95 326 866 285) of PO Box 1407, Paradise Point QLD 4216 (“Zephyr and Stone”, “we”, “us”) and you, the person or business who accepts them (“you”). They cover the images you supply to Zephyr and Stone, or that you otherwise agree Zephyr and Stone may use, from the date you accept these terms onwards.

What you are agreeing to. You grant Zephyr and Stone a non-exclusive, worldwide, royalty-free, ongoing licence to use, reproduce, resize, crop and overlay text or branding on those images, across Zephyr and Stone’s channels and materials, including its website, blog, social media, email, video platforms, marketing materials, and educational and digital products (free or paid).

Credit, our commitment to you. Everywhere the images are used, Zephyr and Stone will credit you, and where you tell us, your photographer, for the design, in the form most practical for that platform. On Instagram and other social platforms this is a tag of your handle. On the website, in email and in other written material it is a written credit using the credit line you nominate when you accept these terms.

What you keep. You keep full ownership and copyright of your images. This licence is non-exclusive, so you can keep using the images however you like and license them to anyone else. Zephyr and Stone will not sell the images themselves or license them on to third parties as standalone images.

Your confirmation. You confirm that you own the copyright in the images or have the photographer’s, or other rights holder’s, authority to grant this licence, that you are authorised to enter into this agreement on behalf of your business, and that using the images as described above will not infringe anyone else’s rights.

Changing your mind. If you ever want us to stop using the images in new material, tell us in writing and we will stop within 30 days. Material already published or in circulation at that time may remain.

General. No fee is payable by either party. These terms are the entire agreement between us in relation to the images and replace any earlier understanding about their use. This agreement is governed by the laws of Queensland, Australia.

Version 1.0

I own the copyright in these images, or have the photographer's or other rights holder's authority to grant this licence, and I have the authority to enter into this agreement. I have read and accept the Zephyr and Stone Image Licence and Credit Agreement, Version 1.0.
